This text proposes some lines of reflection and action related to a project that links philosophy and childhood, whose pedagogical and investigative activity has been developed in the province of Córdoba, Argentina, for more than twenty-five years. To do this we recover an experience of workshops with children and adults, in a continuous process of reflection on childhood and how children think about themselves. That experience focuses on imagining a particular space and time – living together on an island where (...) adults cannot be found--and from there question the forms of decision making and participation – of political action – that children perform in the territories they inhabit. Here it is proposed that the circumstance of incompleteness regarding issues such as politics and sexuality encompass all age situations and, therefore, it is more appropriate to let ourselves be traversed by restlessness and doubt than to accept a preconceived world in which problems quickly find answers, and what you do not know or cannot be located in a fixed category is unknown, ignored, or remains hidden. We propose to start by not postulating any pre-conceived notions regarding childhoods--thinking of them as hypotheses with unexplored names, bodies and thoughts to get to know. Likewise, it is assumed that reflection on teaching practice relocates philosophy teachers as intellectuals who keep universal explanations in their “professorial pockets,” and reinvent themselves by dealing with specific problems, the small discoveries one makes through exchanges with others--those others that, as in the case of children, there is much to learn about and from. This is the ethical and political task that emerges from a continuous reflection on shared action. Welcome, then, to the island where everything is to be decided and participated in, the island of Serendipity. (shrink)

El presente estudio se refiere a una de las cuestiones más importantes en el ámbito de la filosofía política clásica y escolástica, como lo es el del origen del poder, según es propuesto por la llamada “teoría de la traslación”, cuyo más connotado sostenedor ha sido Francisco Suárez. En primer lugar, se analiza críticamente la teoría de la traslación en la versión del propio Suárez. Luego, el artículo enfoca el tratamiento de un caso histórico representativo, en el cual el poder (...) político pareció haber sido “trasladado”, con el fin de evaluar el valor de verdad de la teoría en cuestión a la hora de explicar el origen del poder en el plano empírico. El artículo pone de relieve el papel axial del bien común sobrenatural en la doctrina tomista de la legitimidad política. Con el fin de estudiar esa tesis en la Escuela Tomista contemporánea, el autor se centra en el tratamiento del tema de las relaciones entre Iglesia y Estado en la obra de un importante filósofo tomista del siglo XX, Julio Meinvielle (+1973).

El presente artículo se introduce en la cuestión de la reversión del poder a partir de las posiciones de Suárez sobre el origen de la potestad política. A continuación aborda el problema en autores representativos de la segunda escolástica. Por último, con el ejemplo de los sucesos posteriores a 1808 en los reinos americanos de la monarquía castellana, intenta determinar si es dable sostener en la realidad objetiva alguna forma de reversión del poder a la comunidad.

En la doctrina del derecho internacional de Hermann Heller el dato fundamental del orden jurídico lo constituye la presencia de unidades decisorias soberanas, individualizadoras del derecho. Heller agrega que, paradojalmente, la existencia del derecho positivo depende de la acción legibus soluta de tales unidades comunitarias. Aunque obligados por “principios jurídicos fundamentales”, los Estados, ante una amenaza que los ponga en riesgo y comprometa, por ende, a la totalidad del orden jurídico, pueden modificar a éste último parcialmente. Así pues, respecto del (...) orden jurídico positivo, el Estado permanece como elemento determinante. Y, dado que en el orden internacional no hay una civitas maxima, sino pluralidad de Estados, serán éstos quienes libremente determinen el derecho internacional público. El Estado nace y perdura como una cierta realidad social y existe como sociedad política –con la legitimidad correspondiente- aun cuando no entable relaciones jurídico-internacionales de ninguna especie. En conclusión, para Heller si el Estado no aparece ni pervive por decisión del derecho internacional, luego tampoco su potestad se origina en una delegación o distribución de funciones emanada de tal orden normativo. This article means to show how Aristotelian second scholasticism on the one hand, and Hermann Heller on the other, converge to assert the supremacy of political power, the politicity of positive law, the independence of the political community and its role as a primary subject of international law. These coincidences between the founders of modern international law and the great theoretician of the State become evident not in their respective philosophical premises, but, above all, in their conclusions on the properties (...) they attribute to the political community. Furthermore, as it is also stated in this article, the principles put forward by Vitoria, Suárez and Heller have not lost their deontic value and constitute objective legitimacy bases on which contemporary political processes may be judged. Thus, there has been an accelerated development of an unprecedented number of COVID-19 vaccine candidates to control the pandemic. The World Health Organization’s emergency use authorization of COVID-19 vaccines still in clinical trial allowed immunizing the population. This paper presents a perspective of the bioethical precepts of autonomy, non-maleficence, beneficence, and justice in the emergency use of COVID-19 vaccines. In today’s world, given the relative importance that companies are giving to corporate social responsibility, sustainability, human rights, and ethics, it is logical to assume that the humanistic trend is gaining support over the economistic, especially in the most developed countries. The paper serves both to introduce the topic of circular migration and to suggest that humanistic management principles are not applied to circular migration programs. First, we contrast humanism with economism as fundamental approaches to business goal setting. Then, we (...) discuss in more depth the concept of circular migration and explain the mechanisms under which this migration happens in the US and Canada. Next, by relying on Melé’s propositions, we elaborate on the case of the Mexican workers who enroll in these temporary job programs, with attention to the programs’ pitfalls and outcomes. Finally, we conclude with reflections on further research in humanistic management as a tool for improving temporary migration movements. (shrink)

The purpose of this study is to determine empirically the state of the art of the medical care, when healthcare personal is confronted with ethical dilemmas related with the care they give to the geriatric population. An observational, longitudinal, prospective and qualitative study was conducted by analyzing the correlation between healthcare personnel–patient relationship, and ethical judgments regarding dilemmas that arise in daily clinical practice with geriatric patients. Mexican healthcare personnel with current active practices were asked to write up an ethical (...) dilemma that arose frequently or that had impacted their medical practice. From the narrative input, we were able to draw up a database with 421 dilemmas, and those corresponding to patients 60 years and older were selected (n = 54, 12.8 %). The axiological analysis of the narrative dilemmas of geriatric patients was made using dialectical empiricism. The axiological analysis values found most frequently were classified into three groups: the impact of healthcare, the roles of the physician, and refusal of therapy; the healthcare role of educator, caring for the patients’ life and the risk of imminent death where the values found more often. The persistence and universality of certain dilemmas in geriatrics calls for awareness and requires a good training in the ethical discernment of these dilemmas. This would help to improve substantially the care and the life quality of this population. (shrink)

This work analyzes and characterizes the spread of the COVID-19 disease in Mexico, using complex networks and optimization approaches. Specifically, we present two methodologies based on the principle of the rupture for the GC and Newton's law of motion to quantify the robustness and identify the Mexican municipalities whose population causes a fast spread of the SARS-CoV-2 virus. Specifically, the first methodology is based on several characteristics of the original version of the Vertex Separator Problem, and the second is based (...) on a new mathematical model. By solving VSP, we can find nodes that cause the rupture of the giant component. On the other hand, solving the NLM can find more influential nodes for the entire system’s development. Specifically, we present an analysis using a coupled social network model with information about the main characteristics of the contagion and deaths caused by COVID-19 in Mexico for 19 months. This work aims to show through the approach of complex networks how the spread of the disease behaves, and, thus, researchers from other areas can delve into the characteristics that cause this behavior. Brazil, land of miscegenation (métisse). An indisputable fact and an unending process. But how should we understand its genesis and how should we, while respecting the requirements of a historiography worth the name, interpret it in terms of our hopes for the future? This is the horizon binding these reflections, which is to be put in perspective in the studies published in this issue of Diogenes.Foregrounding miscegenation, and understanding its origins, has been one of the constant themes among the most (...) distinguished practitioners of Brazilian thought since the 1930s, and has been accepted, indeed demanded, since the 1920s by the artistic and literary movement known as ‘modernism’, of which one of the major figures was the São Paulo writer, Mário de Andrade. Gilberto Freyre (1900–1987), who would now have been a hundred years old, comes particularly to mind, as does Sergio Buarque de Holanda (1902–1982). Freyre made history with the publication of his two first works, Casa Grande & senzala [Masters and Slaves] of 1933 and Sobrados e mucambos of 1936. The same year Buarque de Holanda published his Raízes de Brasil [Roots of Brasil]. Motivated by the desire to understand their country, its shaping and – with some kind of concern as to identity – their own origins, both had been led to pave the way for what might be called an ‘open’ sociology, which immediately acquired a strongly anthropological character with Freyre and quickly incorporated increasingly historical aspects with Buarque de Holanda. This paper explores the ethical dilemma of conflicting loyalties found in whistleblowing. Central to this dilemma is the internal/external disclosure dichotomy; disclosure of organisational wrongdoing to an external recipient is seen as disloyal, whilst disclosure to an internal recipient is seen as loyal. Understanding how the organisation and society have dealt with these problems over the last 30 years is undertaken through an analysis of Vandekerckhove’s project, which seeks to place the normative legitimisations of whistleblowing legislation and organisational whistleblowing policies (...) within a globalisation semantic able to contain this conflict between society and the organisation. This project fails, it is argued, because of Vandekerckhove’s particular understanding of the organisation as an autopoietic system, i.e. an operationally closed system. A case is made to understand organisations as complex systems, i.e. operationally open systems. Critical Complexity theory sees the identities of systems and components as coterminous. In the context of the organisation, this means that the identities of the corporation and its corporate members arise and die together. The whistleblower’s disclosure reconfigures the organisation by forcing the organisation to open up and make its boundaries flexible, making the designation ‘internal’ or ‘external’ to the organisation, and, therefore, who qualifies as a recipient of a disclosure of wrongdoing, flexible. The organisation is restrained from retailing against the whistleblower, because its identities are coterminous. Furthermore, as the disclosure cannot be categorically defined as either internal or external, the question of whether an external disclosure can qualify as an act of organisational loyalty becomes moot. The death penalty raises ethical questions at a minimum of two levels: regarding the persons directly involved in the events and penal procedures, and regarding the life and structures of society. The issue lies within the wider question of punishment, which calls into question 'justice' in personal and social life, the idea of the common good, finality and shared logics. As understood ethically, the common good indicates, in the sharing of existence, the meaning and purpose of every form of social (...) life. It is widely assumed that functional and dispositional properties are not identical to their physical base, but that there is some kind of asymmetrical ontological dependence between them. In this regard, a popular idea is that the former are realized by the latter, which, under the non-identity assumption, is generally understood to be a non-causal, constitutive relation. In this paper we examine two of the most widely accepted approaches to realization, the so-called ‘flat view’ and the ‘dimensioned view’, and we (...) analyze their explanatory relevance in the light of a number of examples from the life sciences, paying special attention to developmental phenomena. Our conclusion is that the emphasis placed by modern-day biology on such properties as variability, evolvability, and a whole collection of phenomena like modularity, robustness, and developmental constraint or developmental bias requires the adoption of a much more dynamic perspective than traditional realization frameworks are able to capture. O conceito de pseudo-ciência procura identificar propostas que têm uma aparência científica mas que não satisfazem critérios rigorosos de cientificidade. Alguns exemplos muito citados de pseudo-fenômenos estão os fatos alegados pela parapsicologia e pela astrologia. Para caracterizar a pseudo-ciência alguns autores propuseram critérios psicológicos, sociológicos ou metodológicos. O objetivo básico de uma caracterização metodológica dos pseudo-fenômenos é permitir identificar aquilo que parece existir, mas não existe. Trata-se, portanto, de uma distinção essencialmente ontológica. Este trabalho irá descrever várias tentativas de estabelecer (...) critérios desse tipo e mostrará que nenhuma delas é satisfatória. Será apresentada uma abordagem alternativa, compatível com o caráter provisório do conhecimento científico, que permite avaliar a proposta de existência de um novo fenômeno e guiar a pesquisa, sem no entanto permitir concluir se o fenômeno existe ou não. A IDENTIFICAÇÃO DO DIREITO AMBIENTAL MARÍTIMO.

This paper explores some of the philosophical difficulties involved in the task of clarifying the idea of an irreducible statistical law, by means of an analysis of the paradigmatic example of such a law in the Quantum theory.These are two alternative strategies that can be pursued in clarifying this question. One is to understand this irreductibility by means of one or another interpretation of the Quantum theory. But, as will be shown, the different interpretations of Quantum mechanics lead to radically (...) different and fundamentally incompatible answers to the problem. The second strategy is to try to caracterize this irreducibility “directly”, via a proof of the impossibility of a hidden-variable extension of the statistical formalism of the theory. This strategy culminates with Bell’s theorem which indeed establishes the impossibility of constructing “Iocal” theories of hidden variables. This impossibility result, however, fails to provide us with a satisfying interpretation of the quantum irreductibility, rather, it merely shows how far we are from a solution to the problem. In this paper, I explore a new type of semiotic translation in the context of Audiovisual Translation Studies (AVTS). To that end, a set of formulaic sequencesbestowed of pragmalinguistic value (hedging strings) is analysed. It is argued that the semiotic analysis of conversational features in English may contribute to facilitate their pedagogical exploitation in English as a Foreign Language (EFL) classrooms. This analysis builds theoretically on a semiotic translational framework termed Semiosic Translation (and its subset, Semiosic Subtitling) predicated upon three (...) types of translation: (i) Metaleptic translation; (ii) indexical translation; and (iii) translation as dynamic discontinuity. Th e translational rationale thus arrived at is deemed to account for what it is that binds together linguistic signs with other sign systems. (shrink)

The author reexamines a number of foundational episodes in the history of western thought through the prism of the notion of “identity philosophy,” a category that includes both parmenidean metaphysics, predicated on the assumption of a transparent relationship between reality and logos, to the exclusion of the irrational and the nothing from the number of thinkable realities, and a Wittgenstein-influenced philosophy of language implying that nothing can be said unless it has previously been fitted to the mathematical form of linguistic (...) articulation that is logics. The question arises of the truth value and sense of dimensions that eludes identity: event, tale and myth. The fact of literature implies that these dimensions somehow partake of truth and sense, but certainly not in the same way as philosophical discourse. How does this happen? What sort of legitimacy can literature draw from philosophy? What does it mean to step beyond Wittgenstein and speak of “narrative thought?”. (shrink)
